Procedural Posture

Miscellaneous Application / Ruling on Application for Extension of Time and Leave to Appeal

  1. 1 Whether the applicant should be granted leave to file an appeal out of time.
  2. 2 Whether the notice of appeal filed without leave should be deemed as duly filed and served.
  3. 3 Whether sufficient cause was shown for the delay in seeking leave to appeal.

Ratio Decidendi

The court held that while it has the discretion to extend time for filing an appeal, such discretion must be exercised judiciously and only where sufficient cause for the delay is demonstrated. In this case, the applicant failed to provide a reasonable or credible explanation for the delay in seeking leave to appeal, and the delay was found to be inordinate. The court further noted that the applicant did not provide security for the due performance of any order that may ultimately be binding. Consequently, the court found the applicant undeserving of the equitable remedy of extension of time and dismissed the application in its entirety.

Court Disposition

application dismissed

Orders

  • The application for extension of time and leave to appeal is dismissed.
  • No orders as to costs; costs to abide the outcome of the intended appeal if any.
