Legal Issues
- 1 Whether the applicant is entitled to resentencing for the offence of robbery with violence.
- 2 Whether the court has sufficient material to exercise discretion in resentencing.
Ratio Decidendi
The court declined to consider the merits of the application for resentencing because the applicant failed to provide any material, such as proceedings or judgments from the trial or appellate courts, to assist the court in exercising its discretion. Without such records, the court could not properly assess the circumstances of the conviction or sentence, and therefore dismissed the application for lack of merit and supporting documentation.
