The court found that the ruling delivered on 16th November 2011 by Onyancha J contained an error apparent on the face of the record because the order of distribution did not reflect the Judge's clear intention that the estate be distributed as originally proposed by the original petitioner. The Judge had repeatedly stated that the families of the two brothers should get equal shares, but the final order deviated from this. By virtue of Order 45 of the Civil Procedure Rules, as read with Rule 63 of the Probate and Administration Rules, the court has jurisdiction to review its own orders in succession proceedings where such an error is evident.
