Procedural Posture

Succession Cause / Ruling on Summons for Revocation and Annulment of Grant

  1. 1 Whether the objector is a son of the deceased and thus entitled to a share of the estate.
  2. 2 Whether the petitioner is a rightful beneficiary of the deceased's estate.
  3. 3 Whether the grant issued to the petitioner should be revoked or annulled.

Ratio Decidendi

The court found that the objector failed to provide credible evidence that he was a son of the deceased, Ebu Omusoli, and thus not entitled to the share of the estate distributed to the petitioner. The petitioner was established as the only surviving sibling of the deceased and therefore the rightful beneficiary of his share of the estate. The objector, being the son of Etyakoro Omusol (the deceased's brother), is entitled only to his late father's and grandfather's shares, not to the share inherited by the petitioner. The application for revocation of the grant was therefore without merit and dismissed.
