Ratio Decidendi

The court found that the grant of letters of administration intestate was confirmed contrary to the law, as the identities and shares of all beneficiaries were not ascertained before confirmation. The entire estate was vested in the respondent, despite the existence of other beneficiaries entitled to specific shares. This failure to comply with the mandatory provisions of the Law of Succession Act justified the revocation of the grant. The court exercised its jurisdiction under section 76 to revoke the grant and ordered that a fresh grant be issued to include all relevant beneficiaries as administrators, with a directive to apply for confirmation within thirty days.
