However, the documentary evidence provided by both parties was inconclusive as to whether parcel 834 was subdivided into the parcels claimed by the Respondent or whether the register for parcel 834 had been closed. Given the uncertainty and the ongoing nature of the dispute, the court held that it was fair and just to preserve the Applicants' possession of the land pending the hearing and determination of the main suit.
