The court held that once a notice to withdraw a suit is filed under Order 25 Rule 1 of the Civil Procedure Rules, the suit is automatically withdrawn and ceases to exist, regardless of whether the court endorses the notice. There is no legal provision allowing for the withdrawal of such a notice or for the revival of the withdrawn suit. Consequently, the Kakamega suit was no longer pending and was not available for transfer to the Butali court. Any attempt to transfer a non-existent suit would be pointless and amount to an abuse of court process, as it would result in duplicative proceedings.
