The respondents did not accord the claimants a fair hearing as required by Section 41 of the Employment Act, 2007. The silence and inaction of the respondents after the criminal case amounted to unlawful and unjustified termination. The court held that the claimants were entitled to compensation for unlawful termination, including one month’s salary in lieu of notice and twelve months’ salary as compensation, as well as costs of the suit.
