The court found that the Plaintiff, acting under a valid Power of Attorney from the original allottee Samuel Wamutu Waiganjo, established the root of title to the suit property through a valid letter of allotment and subsequent payments. The allocation to Samuel Wamutu Waiganjo was never revoked, and there was no evidence that the 1st and 2nd Defendants were ever lawfully allotted the property. Consequently, the 1st and 2nd Defendants could not pass good title to the 3rd Defendant, whose registration was therefore unprocedural and impeachable under Section 26 of the Land Registration Act. The 3rd Defendant, though an innocent purchaser for value, could not acquire a better title than that...
