Ratio Decidendi

The court held that the Land Disputes Tribunal acted without jurisdiction when it purported to revoke titles and direct the issuance of new titles for parcels Githunguri/Gathangari/2033 and 2242, as such matters concern title to land and succession, which are outside the Tribunal's statutory mandate under section 3 of the repealed Land Disputes Tribunals Act. The Tribunal's decision was therefore null and void ab initio, and its adoption by the Resident Magistrate's Court could not cure the defect. The court emphasized that jurisdiction is conferred by law, not by the parties' participation or consent. Consequently, the court issued orders of certiorari to quash the Tribunal's decision...
