Procedural Posture

Notice of Motion / Ruling on Preliminary Objection/application to Dismiss for Want of Jurisdiction

  1. 1 Whether the Machakos Law Courts have territorial and substantive jurisdiction to hear and determine the defamation suit filed by the plaintiff.
  2. 2 Whether filing the suit in Machakos, rather than Nairobi where the cause of action arose and the defendant carries on business, renders the suit a nullity or warrants dismissal.
  3. 3 Whether the provisions of the Civil Procedure Act on place of suing oust the countrywide jurisdiction of Magistrates' Courts under the Magistrates' Courts Act, 2015.

Ratio Decidendi

The court held that the Magistrates’ Courts Act, 2015, as the principal legislation, confers countrywide jurisdiction on magistrates’ courts and does not impose territorial limitations. The provisions of the Civil Procedure Act regarding the place of suing are procedural and intended for convenience and cost management, not to oust the substantive jurisdiction of magistrates’ courts. Filing a suit in a court outside the local limits where the cause of action arose or where the defendant resides does not render the suit a nullity or deprive the court of jurisdiction. The appropriate remedy for a defendant aggrieved by the venue is to seek transfer of the suit to a more convenient court...

Court Disposition

application dismissed

Orders

  • The defendant's application to dismiss the suit for want of jurisdiction is dismissed for lack of merit.
  • The applicant is at liberty to approach the High Court for transfer of the suit on grounds of convenience and costs, if so desired.
