The court found that the Applicants had demonstrated discovery of new and important evidence—namely, that the land parcel awarded to them by judgment had, after suit was filed, been registered in the name of Paul Ngigi Nyagah, a non-party. This fact was not within their knowledge at the time of judgment. The court held that the transfer to Paul Ngigi Nyagah, effected despite a caution and after the Applicants' claim for adverse possession had been established, could not defeat the Applicants' entitlement under the decree.
