The Court of Appeal affirmed that the agreement for sale of agricultural land between the parties was void for want of Land Control Board consent as required by section 6 of the Land Control Act. Since no application for consent was made or obtained, the respondent acquired no legal or registrable interest in the suit land and thus had no right to register a caveat. However, section 7 of the Land Control Act entitles a party who has paid consideration under a void transaction to recover it as a debt.
