Ratio Decidendi

The court found that the Land Dispute Tribunal lacked jurisdiction to determine disputes concerning title or ownership of registered land, as such jurisdiction is not conferred by the Land Dispute Tribunals Act (repealed). The dispute before the Tribunal was fundamentally about ownership of registered land, and thus, any orders made by the Tribunal, including cancellation of title, were null and void for want of jurisdiction. The court also determined that the appeal was not time-barred, as the right of appeal accrues from the date the judgment is read, not the date of the award. Consequently, the appeal was allowed, and the Tribunal's decision was set aside.
