Procedural Posture

Civil Appeal / Ruling on Application for Review of Costs Order

  1. 1 Whether the 2nd Interested Party should be condemned to pay costs when it was joined to the proceedings by court order and did not cause the events leading to the appeal.
  2. 2 Whether the order as to costs in the judgment was ambiguous or erroneous and required clarification or review.
  3. 3 Whether the Registrar of Trade Unions, as the losing party, should bear the costs of the appeal.

Ratio Decidendi

The court found that the judgment was against the Registrar of Trade Unions, whose decision was overturned, and not against the Interested Parties. The Interested Parties were joined because the orders of the court were likely to affect them and because they had raised objections when invited by the Registrar, in compliance with Section 17(3) of the Labour Relations Act. The court held that the losing party is the Registrar of Trade Unions, and therefore, the Registrar should bear the costs of the appellants. The application for review was allowed to the extent that the 2nd Interested Party should not be condemned to pay costs, and the order as to costs was clarified accordingly.

Court Disposition

Application for review of costs order allowed; costs to be borne by the Registrar of Trade Unions, not the 2nd Interested Party.

Orders

  • The Registrar of Trade Unions shall bear the costs of the appellants.
  • The 2nd Interested Party shall not be liable for costs.
