The High Court found that the trial court erred by summarily dismissing the appellant’s suit without affording her an opportunity to be heard on its merits. Although the trial court had the power to order DNA testing and to strike out pleadings under Order 2 Rule 15 of the Civil Procedure Rules, such powers must be exercised cautiously and only in clear cases where no reasonable cause of action exists.
