Ratio Decidendi

The Court of Appeal found that the applicant had demonstrated an arguable appeal, particularly on the issue of whether it was established that he planted sugarcane on the suit property after the issuance of the court order. The Court held that the appeal would be rendered nugatory if the stay was not granted, as the subject matter of the appeal would not be preserved. Applying the principles under Rule 5(2)(b), the Court exercised its discretion to grant a stay of execution of the ruling and order of the High Court pending the hearing and determination of the appeal. The costs of the application were ordered to abide by the outcome of the appeal.
