Ratio Decidendi

The Court of Appeal found that the appellant was suspended, not summarily dismissed, as evidenced by the suspension letter which specified suspension pending the outcome of criminal proceedings. There was no contractual or statutory basis for withholding salary during the suspension period. The respondent failed to communicate any further action after the appellant's acquittal, and by not reinstating him, effectively terminated the employment relationship at that point. The appellant was therefore entitled to salary for the period of suspension (5th April 2004 to 27th May 2007), but not beyond.
