The court found that the five plaintiffs, suing on behalf of themselves and 700 other tenants, were required by Order 1 rule 12 of the Civil Procedure Rules to obtain written authority from each of the other tenants and file such authority in court. The evidence showed that only 235 tenants were listed as having given authority, and of those, only about 165 had actually signed. This left a significant number of purportedly represented tenants without having given the requisite authority.
