The plaintiffs failed to comply with the terms of the agreement within the stipulated period, and the defendant's subsequent letter of 9th March 2005 confirmed the lapse and reinstated the outstanding balance with accruing interest. The court held that the cause of action, if any, accrued on 9th March 2005, when the plaintiffs were notified of the lapse. Since the plaintiffs' application was filed more than six years after this date, it was time barred under section 4 of the Limitation of Actions Act.
