The High Court found that the trial court erred in adopting the minimum wage as the multiplicand for loss of dependency in the absence of documentary evidence of the deceased's earnings. The only undisputed evidence was that the deceased contributed Kshs.3,000 per month to his father, which was reasonable to adopt as the multiplicand. The court recalculated the award for loss of dependency using Kshs.3,000 per month, a multiplier of 25 years, and a dependency ratio of 2/3, resulting in Kshs.600,000.
