Ratio Decidendi

The court found that both the applicant and the objector were named as beneficiaries in the original petition for grant of letters of administration, and that the objector had an equal opportunity to apply for substitution but did not do so. The court held that, in the interest of justice and to avoid further delay, both Philip Mukoya Lumuli and Athanas Andole Shiloya should be appointed as joint administrators in place of the deceased petitioner. The court exercised its discretion under Rule 73 of the Probate and Administration Rules to allow the application with modifications, ordering the issuance of a fresh grant in their joint names and cancellation of the previous grant.
