The court found that the respondent obtained the grant of letters of administration intestate by failing to disclose all beneficiaries and without notifying or seeking the consent of the applicant and other entitled persons, in violation of Rule 26(1) of the Probate and Administration Rules and Section 76 of the Law of Succession Act. The proceedings were therefore defective in substance, and the grant was obtained fraudulently by concealment of material facts. The court held that these were sufficient grounds for revocation of the grant.
