The court held that the purported sale of eight acres of estate land by Zakayo Chepkonga Cheruiyot to Grays Jepkemoi Kiplagat was null and void as it occurred before the grant of letters of administration was issued and confirmed, contrary to Section 82(b)(ii) of the Law of Succession Act. Grays could not be considered a beneficiary or creditor of the estate since she did not transact with the deceased prior to his death, and her only recourse is a direct claim against Zakayo. The inclusion of Grays as a beneficiary was therefore erroneous. The court confirmed the grant in accordance with the mode of distribution proposed by Hosea K.
