Procedural Posture

Miscellaneous Application / Ruling on Application for Extension of Time and Stay of Execution

  1. 1 Whether the applicants have demonstrated sufficient cause for extension of time to file an appeal out of time.
  2. 2 Whether the applicants are entitled to stay of execution of the judgment/decree pending appeal.

Ratio Decidendi

The court found that the delay in filing the appeal was not inordinate given the special circumstances of the Covid-19 pandemic, which led to downscaling of court operations and closure of offices. The applicants made efforts to obtain the judgment and demonstrated that the delay was explained and justified. The draft memorandum of appeal raised arguable grounds, and the respondent would not suffer prejudice by the grant of leave. The court therefore exercised its discretion to allow the application for extension of time to file the appeal and granted a stay of execution pending the hearing and determination of the intended appeal.
