Upon the deceased's death, his share was to be distributed as part of his estate. Although Fredrick Cheywe Kikuyu, the only surviving child, would ordinarily inherit under section 38 of the Law of Succession Act, he expressly disclaimed any interest in the land, having been provided with another parcel (no. 2811) by Johana Keya Kikuyu.
