Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicants have satisfied the conditions for grant of stay of execution pending appeal under Order XLI Rule 4(2) of the Civil Procedure Rules.
  2. 2 Whether the applicants have demonstrated substantial loss may result if stay is not granted.
  3. 3 Whether the respondent has sufficiently demonstrated his ability to refund the decretal sum if the appeal succeeds.

Ratio Decidendi

The court found that the applicants had expressed a reasonable apprehension that the respondent may be unable to refund the decretal sum if the appeal succeeds, and that the respondent had not sufficiently demonstrated his means beyond mere assertion. The court held that the applicants' fear of substantial loss was not unfounded. However, to balance the interests of both parties, the court ordered a stay of execution on condition that the applicants deposit the decretal sum in an interest-earning joint account and comply with procedural requirements for the appeal. Failure to comply with these conditions would result in the lapse of the stay order.

Court Disposition

Conditional stay of execution granted pending appeal.

Orders
