Ratio Decidendi

The High Court is bound by the clear and unchallenged order of the Court of Appeal requiring the property to be valued by an independent valuer, to be agreed upon by the parties or, failing agreement, to be nominated by the court. The parties have failed to agree on a valuer for nearly eight years. The plaintiff's objections regarding forum and alleged bad faith do not override the binding appellate order. The court lacks jurisdiction to question the propriety of the appellate order and must enforce it as long as it stands. The suit was properly filed in the Civil Division, and the complaint about forum is without merit. The application for appointment of a valuer is therefore granted.

  • An independent valuer for LR No. Nairobi/Block 32/26 shall be nominated by the court as per prayer (i) of the notice of motion dated 29th April, 2010.
