The defendant, despite being served, failed to appear or provide any evidence to rebut the plaintiffs' case. The evidence showed that the defendant fraudulently caused the land to be registered in his name and subsequently sold it to a third party, who successfully sued for a refund after discovering the fraud. The court held that, under Section 26 and Section 80(1) of the Land Registration Act, a title acquired through fraud is impeachable and the register can be rectified.
