The court found that the Plaintiff had not demonstrated any new and important matter or evidence, mistake, or error apparent on the face of the record to justify review under Order 45 Rule 1 of the Civil Procedure Rules. The court held that non-compliance with a court order, such as failure to provide a bank guarantee, does not in itself provide grounds for review. Instead, the appropriate remedy for disobedience of court orders is to pursue contempt proceedings, not review. The Plaintiff's application was therefore dismissed as it did not meet the legal threshold for review, and the court declined to speculate on issues not properly submitted before it.
