Ratio Decidendi

The court found that Gabriel Ocholi Mukoko acquired the land parcel Marama/Shiraha/449 as a bona fide purchaser for value from an administrator who had been granted representation. The transfer was effected before the grant was revoked. Section 93 of the Law of Succession Act protects such a purchaser, and the subsequent cancellation of the grant and transfer could not defeat his title. There was no opposition to the application, and the evidence showed proper service of the hearing notice. The court therefore allowed the application and set aside the orders cancelling the grant and transfer, restoring the purchaser's title.
