The Defendant admitted in his pleadings to selling at least four acres but failed to adduce any evidence to challenge the Plaintiff's claim to the full six acres or to support his counterclaim. The court found that the Plaintiff's evidence was credible and remained unchallenged, and that the Defendant's refusal to transfer the land amounted to unjust enrichment.
