Ratio Decidendi

The court found that the claimant was terminated on allegations of being a suspect in thefts at the respondent's premises, but was never charged with any offence nor subjected to an internal disciplinary hearing. The respondent failed to provide valid reasons for termination and did not follow fair procedure as required by law. The court held that the termination was unfair and unjustified under section 45(2) of the Employment Act. The claimant was therefore entitled to compensation for unfair termination equivalent to 12 months' wages. The claims for overtime and public holidays were not proved to the court's satisfaction and were dismissed. Costs and interest were awarded to the claimant.
