Ratio Decidendi

The court found that the applicable law was the repealed Employment Act (Cap 226) since the termination occurred before the Employment Act, 2007 came into force. Under the repealed Act, an employer could terminate employment by giving notice or payment in lieu thereof without assigning a reason, and there was no statutory requirement for a hearing. Although the Respondent advanced a reason for dismissal (alleged theft), there was insufficient evidence to substantiate the allegations even on a balance of probabilities.
