Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant’s employment was lawful and fair.
  2. 2 Whether the Claimant is entitled to the remedies sought.

Ratio Decidendi

The court found that the Respondent failed to prove that the Claimant deserted duty or was properly notified of the intention to terminate his employment. The alleged show cause letter was not served, and the Respondent did not make reasonable efforts to contact the Claimant. The termination was therefore without justifiable cause and in violation of due procedure. The Claimant was entitled to compensation for unfair termination and accrued leave pay, but not to notice pay or public holiday pay, as these were either already settled or unproven.

Court Disposition

Judgment for the Claimant in part.

Orders

  • The Respondent shall pay the Claimant Kshs. 40,000 as compensation for unfair termination.
  • The Respondent shall pay the Claimant Kshs. 7,200 for 27 days’ accrued leave.
