Procedural Posture

Miscellaneous Application / Interlocutory Application for Mandatory Injunction

  1. 1 Whether the applicant has established a prima facie case for the grant of a mandatory interlocutory injunction for repossession of the motor vehicle.
  2. 2 Whether the applicant has provided sufficient evidence of ownership of the household items to warrant a mandatory injunction.
  3. 3 Whether special or exceptional circumstances exist to justify the grant of a mandatory injunction at the interlocutory stage.

Ratio Decidendi

The court found that the applicant had established a prima facie case for the grant of a mandatory interlocutory injunction in respect of the Toyota Prado vehicle. The applicant produced a registration certificate showing him as the registered owner, and the respondent did not contest this evidence. The court held that, in the absence of opposition and given the risk of loss if the vehicle was disposed of during the proceedings, the applicant was entitled to preservation of the vehicle. However, the court found that the applicant had not provided sufficient prima facie evidence of ownership of the household items and thus declined to grant a mandatory injunction in respect of those items....
