Ratio Decidendi

The Tribunal found that while the parties were bound by the terms of the Licence Agreement dated 1st December 2022, including its duration and notice provisions, the statutory requirements under Cap 301 regarding termination of controlled tenancies are mandatory and override any contractual terms to the contrary. Specifically, section 4(4) of Cap 301 requires a minimum of two months' notice for termination, regardless of the lease's fixed duration or any shorter notice period stipulated in the agreement. The landlord's notice, issued on 29th October 2024 to terminate the tenancy by 30th November 2024, failed to comply with the statutory minimum notice period and was therefore defective....
