The court found that although the parties had discussed the possibility of settling the decretal sum by installments, there was no binding agreement as to the amount of the monthly installments, and the correspondence relied upon by the defendants was written on a 'without prejudice' basis. The court held that no enforceable agreement existed for payment by KShs.300,000 monthly installments. However, exercising its inherent jurisdiction and in the interests of justice, the court ordered that the decretal sum of KShs.16,007,739.50 plus costs and interest be paid by monthly installments of KShs.600,000, starting 31st January 2010, with the plaintiff entitled to execute in case of default....
