Ratio Decidendi

The Tribunal found that while both parties submitted valuation reports, the landlord's report included the mezzanine floor as lettable space, whereas the tenant's report excluded it, arguing it was an improvement made at the tenant's cost. The Tribunal accepted that tenant improvements should not be used to increase rent under Cap 301. Consequently, the Tribunal allowed the landlord's notice to alter the terms of tenancy but adjusted the rent upward by 75% of the landlord's proposed figure, excluding the value ascribed to the mezzanine floor. The new rent was set at Kshs 80,580 per month, effective 1st February 2024. Each party was ordered to bear their own costs.
