The Court of Appeal held that its jurisdiction is strictly statutory and can only be exercised where a right of appeal is expressly provided by law. Section 3(1) of the Appellate Jurisdiction Act limits the Court's jurisdiction to cases where an appeal lies to it under any law. The Landlord and Tenant (Shops, Hotels and Catering Establishments) Act, cap 301, specifically provides in section 15(4) that the decision of the High Court on any appeal from the Business Premises Rent Tribunal is final and not subject to further appeal. The Civil Procedure Act, including section 66, does not apply to such appeals, as the Landlord and Tenant Act prescribes its own appellate procedure and expressly...
