Ratio Decidendi

The court held that the Bungoma Chief Magistrate's Court, being a Resident Magistrate's Court, had jurisdiction throughout Kenya by virtue of section 3(2) of the Magistrates Courts Act. Therefore, the restriction imposed by section 15 of the Civil Procedure Act regarding territorial jurisdiction did not apply to Resident Magistrates Courts. Filing the suit in Bungoma did not render it a nullity. However, for the convenience of the parties, particularly the defendant who resides in Kisumu and where the cause of action arose, it was appropriate to transfer the suit to Kisumu Law Courts. The application for transfer was thus meritorious and allowed.
