The High Court found that the trial court erred in awarding general damages that were excessive and unsupported by comparable case law, as well as in awarding future medical expenses that were neither pleaded nor proved. The court also held that special damages cannot exceed the amount specifically pleaded in the plaint, regardless of the amount proved. Consequently, the general damages were reduced to Kshs 250,000, the award for future medical expenses was set aside, and special damages were reduced to Kshs 6,550.
