The letter of cancellation constituted a summary dismissal without sufficient justification or procedural fairness, and the Appellant failed to adduce evidence to support its claim of mistaken employment. The trial magistrate erred in applying the Employment Act 2007, but under the applicable law (Trade Disputes Act, Employment Act 1984), compensation for unfair dismissal was capped at 12 months' gross salary, and damages in lieu of notice were also due. The Respondent was entitled to both, totaling Kshs 112,255. The trial magistrate did not err in awarding interest from the date of dismissal, as the law allows...
