The Court of Appeal found that the applicants had satisfied the two limbs required for the grant of stay under rule 5(2)(b): (1) the existence of an arguable appeal, as the grounds raised were not idle, particularly the challenge to the award of gratuity not pleaded in the trial court; and (2) that the appeal would be rendered nugatory if stay was not granted, given the risk of irrecoverable payment of a substantial sum from public funds and the ongoing judicial review proceedings seeking enforcement.
