The Court found that even if the issue of prescriptive rights was arguable, the applicants failed to demonstrate that the appeal would be rendered nugatory if stay was not granted. The applicants have another parcel of land to which they can relocate if evicted, and there is no evidence that the respondent intends to dispose of the suit property. Additionally, procedural defects in the notice of appeal and delay in filing the appeal further undermined the application. As both requirements for granting a stay—arguability of the appeal and risk of nugatory outcome—were not satisfied, the application for stay of execution was dismissed.
