The High Court found that the trial Magistrate erred by awarding the respondent a larger share of the estate to compensate for expenses incurred in reclaiming land, without first treating the Kshs.80,000 as a liability of the estate and settling it before distribution. The law requires that all debts and liabilities of the estate be settled prior to the distribution of the net estate among beneficiaries. The trial Magistrate also failed to provide a clear basis for equating the value of ½ acre to Kshs.80,000. Consequently, the order confirming the grant was set aside, and the matter was remitted for proper identification and settlement of liabilities before lawful distribution of the estate.
