The cause of action accrued when the respondent suffered loss upon the sale of the property at a loss on 21.12.2016. Under section 4(2) of the Limitation of Actions Act, the suit should have been filed by 21.12.2019. Since the suit was filed on 15.01.2020, it was time barred. The trial court erred in applying section 23(3) of the Act, as the claim was not for a debt but for damages in tort.
