The Business Premises Rent Tribunal, a competent authority, had already determined that there was no tenancy relationship between the parties after expiry of the lease, and the defendant had not appealed that finding. The continued acceptance of rent by the plaintiff did not create a new tenancy, as there was no agreement on rent and the landlord protested the payments. The existence of a pending suit (ELC No 205 of 2012) did not bar the present suit, as the subject matter and prayers were distinguishable.
