Ratio Decidendi

The court found that the suit in the magistrate’s court was struck out for lack of jurisdiction and not heard on merit, thus the doctrine of res judicata did not apply. Although the Trade Marks Tribunal had determined the trademark issue, the plaintiff’s cause of action in the present suit was based on unfair competition, which had not been adjudicated. The court further held that the cited provisions of the Trade Marks Act did not bar the High Court from entertaining the matter, as Section 53 expressly allows aggrieved parties to seek redress in the High Court. Consequently, the preliminary objection lacked merit and was dismissed with costs to the plaintiff.
