Ratio Decidendi

The Court of Appeal held that the application for stay of execution was incompetent because it sought to stay a negative order, namely, the dismissal of an application for review, which does not require any positive action and thus cannot be stayed. The Court further found that the applicants had not demonstrated the existence of an arguable appeal, as the grounds raised did not persuade the Court of any merit. Additionally, the Court noted that the decree of the Environment and Land Court had already been implemented, rendering the application for stay and maintenance of status quo moot. Consequently, the application was dismissed with costs to the 1st respondent.
